27.10.2017 On 10 October 2017, the Russian Constitutional Court amended its Rules and granted official status to amicus curiae submissions by non-governmental organisations and legal experts.

The following amendments were made:

§ 34.1. Amicus curiae briefs

1. Scientific organisations that carry out scientific activities in the field of law and individuals engaged in scientific activities in the field of law may submit an amicus curiae brief in a case before the Constitutional Court. However, a scientific organisation or a legal expert may not request the Court to provide with the case file to prepare its brief.

2. An amicus curiae brief shall be objective and present a politically unbiased legal opinion. An amicus curiae brief may be attached to the case file and forwarded by the Judge Rapporteur to the parties and judges of the Constitutional Court, unless the Judge Rapporteur or the Constitutional Court finds that it brings no information or analytical value to the consideration of a case.

3. The Constitutional Court may decide to publish an amicus curiae brief on its website.


§ 75. Interaction between the Constitutional Court and scientific organisations

1.1. The Constitutional Court may maintain on its website a list of scientific organisations and legal experts that regularly file amicus curiae briefs in proceedings before the Constitutional Court and regularly submit their briefs at the Court’s request. Inclusion in this list will be decided by the Constitutional Court.
