02.12.2016 November 29, 2016: Workshop on Constitutional Litigation for Legal Practitioners within the VI Moscow Legal Week

The Institute for Law and Public Policy (jointly with the Law faculty of the Moscow State University) took part in the VI Moscow Legal Week with the workshop on Constitutional Justice.  The workshop was held by the Institute for Law and Public Policy within the project «Enhancing Civic Engagement in Strategic Constitutional Litigation in Russia» on the premises of the MSU Law faculty with 12 lawyers participated (9 attorneys and 3 lawyers of nonprofit institutions).

The first part of the workshop covered the issues of claim admissibility at the Russian Constitutional Court. The lecturers, Olga N. Kryazhkova and Olga G. Podoplelova, gave detailed clarifications as to claim admissibility criteriae according to the Federal Constitutional Law and current Court practice. The participants had an opportunity to evaluate the prospects of a claim using a model case.

The lecturers drew particular attention to the claim structure and to the issues of legal argumentation, as well as to the necessary stages of legal analysis. The workshop contained a detailed analysis of the most successful argumentation strategies according to the practice of the Constitutional Court and to the lecturers’ relevant practice. The rules of argumentation and methods of argument improvement were also given detailed attention.

At the end of the workshop, the participants received a number of practical tasks on legal argumentation. In particular, the tasks concerned constitutional law arguments in migration and trade mark protection cases. 

According to the participants’ questionnaire data, the workshop was held according to high standards.
